These Terms and Conditions constitute a legally binding agreement between Petraniuk Painting Limited ("the Company," "we," "us") and the client ("the Customer," "you"). By commissioning our services, you agree to comply with and be bound by the following comprehensive terms.
All services are based on the written estimate provided. Any deviations from the initial scope—whether requested by the client or necessitated by site conditions—will be treated as "Variations." Such variations must be agreed upon in writing and may incur additional costs. Estimates are valid for 30 days. We reserve the right to revise any estimate if the site condition differs significantly from the initial assessment.
The Customer must ensure that the work area is reasonably accessible. The Client is responsible for the removal of small, fragile, or high-value items. While our team will move heavy furniture with reasonable care, we accept no liability for damage to items that are not adequately protected or moved by the client prior to our arrival. The client must ensure that all electrical, gas, and plumbing systems are in a safe condition.
We use high-quality materials from reputable suppliers. While we strive for accuracy in color matching, variations in color can occur due to substrate differences, lighting conditions, and paint manufacturer batch inconsistencies. If the client chooses to supply their own paint, we cannot offer any warranty regarding finish, durability, or coverage.
We will make every reasonable effort to meet the proposed schedule. However, any start or completion dates are estimates only. Petraniuk Painting Limited shall not be liable for delays caused by adverse weather conditions, site delays by other trades, late delivery of materials, or circumstances beyond our control. Time is not of the essence unless expressly agreed in writing.
We offer a limited warranty on our workmanship for 12 months. This warranty is void if the defect is caused by external factors, including but not limited to, building movement, dampness, structural defects, misuse, or lack of maintenance by the client. Our total liability under any circumstances shall be limited to the total value of the contract price paid.
Cancellation by the Client must be provided in writing. If a project is cancelled within 48 hours of the agreed start date, a cancellation fee equivalent to 20% of the total quote may be charged. We reserve the right to terminate the contract immediately if the client fails to provide safe access to the site or engages in abusive behavior toward our staff.
We strictly adhere to all relevant UK Health and Safety regulations. We reserve the right to pause work if the environment is deemed hazardous. All waste resulting from our work will be disposed of in accordance with environmental regulations.
We process personal data in accordance with the UK GDPR. Your contact details will only be used for the purposes of fulfilling the contract and will not be shared with third parties without your explicit consent, except as required by law.
This Agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of this contract that cannot be settled through direct negotiation shall be subject to the exclusive jurisdiction of the courts of England and Wales.
